2. Overview of processing activities
The following overview summarizes the types of data processed and the purposes of their processing, and refers to the data subjects concerned.
Types of data processed
- Inventory data (e.g., names, addresses)
- Contact data (e.g., email addresses, phone numbers)
- Content data (e.g., entries in forms)
- Usage data (e.g., pages visited, access times)
- Meta and communication data (e.g., device information, IP addresses)
3. Hosting
Our hosting provider collects the following data that your browser transmits in so-called log files: IP address, date and time of the request, time zone difference from Greenwich Mean Time, content of the request, HTTP status code, amount of data transferred, the website from which the request comes, and information about the browser and operating system.
Hosting provider: Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA.
4. Contact form
If you send us inquiries through the contact form, the information from the inquiry form, including the contact details you provide there, is stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass this data on without your consent.
Legal basis: Art. 6(1)(b) GDPR (General Data Protection Regulation; German: DSGVO) for performance of a contract or pre-contractual measures, and Art. 6(1)(f) GDPR for legitimate interest.
5. Fertility Clinic Finder and sharing with clinics
When you use our Fertility Clinic Finder, we process your answers (e.g., your situation, treatment stage, desired treatment, type of insurance, and, if you wish, your place of residence) as well as your contact details (name, email address, phone number). Some of this information is health data within the meaning of Art. 9 GDPR. In addition, to improve our service, we store the type of page (e.g., a guide article on the topic of costs) and the website (e.g., a search engine) through which you reached the Fertility Clinic Finder. We do not store complete page addresses.
Purpose: Based on your information, we identify suitable fertility clinics, send you your recommendations, and share your information with the clinics identified for you so that they can contact you. You can see which clinics these are in the form before you submit it.
Legal basis: Your explicit consent under Art. 6(1)(a) and Art. 9(2)(a) GDPR. We store when you gave your consent and which version of the consent text you confirmed.
Recipients: the fertility clinics identified for you (up to five). Technical service providers: Cloudflare, Inc. (hosting and database) and Resend, Inc. (sending the confirmation email), both based in the United States. The transfer to the United States takes place on the basis of the EU-U.S. Data Privacy Framework or EU standard contractual clauses.
Location search: If you enter your place of residence in the Fertility Clinic Finder, your entry is sent directly from your browser to the Nominatim service of the OpenStreetMap Foundation (St John’s Innovation Centre, Cowley Road, Cambridge, CB4 0WS, United Kingdom) for the location search. Your IP address is processed in this context. An adequacy decision of the European Commission exists for the United Kingdom. The same applies to the location search in the clinic directory on the provider overview pages. If you use “Near me” there, your location is used only in your browser and is not transmitted to us.
Cost estimate request to a clinic: Using “Request a cost estimate and appointment” in a clinic’s profile, you can send a request to a specific clinic. We then process your name, your email address, your phone number and age group (if you wish to provide them), the topic of your request, and your message. The topic and message can be health data within the meaning of Art. 9 GDPR. As with the Fertility Clinic Finder, we also store the type of page and the website through which you came, without complete page addresses. With your explicit consent (Art. 6(1)(a) and Art. 9(2)(a) GDPR), after you confirm your email address, we share this information with the clinic named in the form so that it can contact you about costs and appointments. From the moment of sharing, the clinic is itself responsible for its own processing. The same applies as for the Fertility Clinic Finder with regard to confirmation, reminder, storage period, and withdrawal.
Newsletter: If you additionally check the box to receive tips about trying to conceive, we use your email address for this purpose on the basis of your consent (Art. 6(1)(a) GDPR). You can unsubscribe at any time by email to [email protected].
Withdrawal: You can withdraw your consent at any time with effect for the future, by email to [email protected]. The lawfulness of the processing carried out before the withdrawal remains unaffected.
Storage period: We store your information until you withdraw your consent or the purpose no longer applies, unless statutory retention obligations prevent this. If you do not confirm your email address, we will send you a single reminder by email after two days and delete your name, email address, phone number, and place of residence after 30 days. The remaining information is retained for statistical analyses without any link to a person.
6. Ovulation Calculator
The Ovulation Calculator runs exclusively in your browser. Your entries (e.g., start of your period, cycle length, answers in the fertility check) are not transmitted to us and are not stored.
Calendar reminder: If you select “Add to calendar,” your browser sends the calculated dates (type and date, e.g., fertile days) once to our server. The server generates a calendar file from them and sends it back. The dates are not stored in the process. The technical service provider is Cloudflare, Inc. (see Hosting). The legal basis is your explicit consent by requesting the file (Art. 6(1)(a) and Art. 9(2)(a) GDPR).
Google Calendar: If you select “Google Calendar,” your browser opens Google Calendar and passes the dates of the fertile days directly to Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). Fertilio does not receive this data. Google’s privacy policy applies.
Fertility Companion by email: If you sign up for it, we store your email address, the time and version of your consent, the date on which we should remind you about a fertility evaluation (if you wish), and the sending status. This reveals that you want a child, which can be health data within the meaning of Art. 9 GDPR. We do not store cycle data. The purpose is to send roughly monthly emails with information about trying to conceive, and the reminder. The legal basis is your explicit consent (Art. 6(1)(a) and Art. 9(2)(a) GDPR), which you confirm through a confirmation link (double opt-in). Technical service providers: Cloudflare, Inc. (database) and Resend, Inc. (email sending), both in the United States, on the basis of the EU-U.S. Data Privacy Framework or EU standard contractual clauses. Storage period: until you unsubscribe; when you unsubscribe, we delete your email address immediately. If you do not confirm the sign-up, we delete it after 30 days. You can unsubscribe at any time through the link in every email or by email to [email protected].
7. Web analytics
We use Umami, privacy-friendly web analytics software. Umami does not collect personal data, does not set cookies, and does not store IP addresses. Only anonymized, aggregated usage statistics are recorded (e.g., page views, time spent on the site, country of origin). Identifying individual visitors is not possible.
Legal basis: Art. 6(1)(f) GDPR (legitimate interest in analyzing website use to improve our offering).
8. Cookies
Our website does not use tracking cookies. Only technically necessary cookies are used, insofar as they are required for the operation of the website.
9. Data subject rights
You have the right:
- to request information about your processed data under Art. 15 GDPR;
- to request the rectification of inaccurate data under Art. 16 GDPR;
- to request the erasure of your data under Art. 17 GDPR;
- to request the restriction of processing under Art. 18 GDPR;
- to receive your data in a structured format under Art. 20 GDPR;
- to object to the processing under Art. 21 GDPR;
- to lodge a complaint with a supervisory authority under Art. 77 GDPR.
10. Changes to this privacy policy
We reserve the right to amend this privacy policy so that it always complies with current legal requirements or to implement changes to our services.
